Terms of Service

By accessing or using the PureVibes website, mobile application, or any associated services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Platform. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and PureVibes Media Ltd. ("PureVibes," "we," "us," or "our").

Your continued use of the Platform following the posting of any changes to these Terms constitutes acceptance of those changes.

You must be at least 16 years of age to use the Platform. By using the Platform, you represent and warrant that:

• You are at least 16 years old, or the age of majority in your jurisdiction.
• You have the legal capacity to enter into a binding agreement and are not barred from doing so under any applicable laws.
• If you are using the Platform on behalf of an organization, you have authority to bind that organization to these Terms.

We reserve the right to request proof of age at any time and to restrict access if we believe you do not meet the eligibility requirements.

To access certain features of the Platform, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate.
• Keep your login credentials confidential and not share them with any third party.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately if you suspect any unauthorized use of your account or any other security breach.

We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, if we reasonably believe you have violated these Terms.

All content published on the Platform — including but not limited to articles, images, graphics, videos, audio, logos, design elements, and software (collectively, "Platform Content") — is owned by or licensed to PureVibes and is protected by copyright, trademark, and other intellectual property laws.

You may:

• Access and read Platform Content for personal, non-commercial use.
• Share links to articles via social media or other channels, provided the content is properly attributed to PureVibes.

You may not:

• Reproduce, distribute, modify, create derivative works from, or publicly display Platform Content without our prior written consent.
• Use any automated systems (bots, scrapers, crawlers) to access or collect Platform Content.
• Remove or alter any copyright, trademark, or other proprietary notices from Platform Content.

The PureVibes name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of PureVibes. You may not use such marks without our prior written permission.

The Platform may allow you to submit, post, or share content such as comments, reviews, or other materials ("User Content"). By submitting User Content, you:

• Grant PureVibes a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the Platform.
• Represent and warrant that you own or have the necessary rights to submit such User Content and that it does not infringe on any third party's rights.
• Acknowledge that PureVibes does not endorse or guarantee the accuracy of any User Content and is not responsible for it.

We reserve the right to remove or modify any User Content at our sole discretion, without notice, for any reason, including content that we believe violates these Terms or is otherwise objectionable.

When using the Platform, you agree not to:

• Violate any applicable local, state, national, or international law or regulation.
• Post or transmit content that is defamatory, obscene, hateful, discriminatory, threatening, or that incites violence.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Interfere with or disrupt the Platform or the servers and networks connected to the Platform.
• Attempt to gain unauthorized access to any portion of the Platform, other accounts, or computer systems through hacking, password mining, or any other means.
• Use the Platform to send spam, chain letters, or other unsolicited communications.
• Collect or store personal information about other users without their express consent.
• Engage in any activity that could disable, overburden, or impair the Platform's functionality.

Violation of these rules may result in immediate termination of your account and may subject you to civil and/or criminal liability.

Certain features of the Platform may be offered on a subscription basis. If you choose to subscribe:

We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination:

• Your right to access the Platform will immediately cease.
• Any provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
• We may, at our discretion, delete your account data, although we may retain certain information as required by law or for legitimate business purposes.

PureVibes does not warrant that:

• The Platform will be uninterrupted, secure, or error-free.
• The results obtained from using the Platform will be accurate or reliable.
• Any content or information obtained through the Platform will meet your expectations.

To the fullest extent permitted by applicable law, PureVibes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Platform.
• Any conduct or content of any third party on the Platform.
• Any content obtained from the Platform.
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total liability exceed the amount you have paid to PureVibes in the twelve (12) months preceding the event giving rise to the claim.

You agree to defend, indemnify, and hold harmless PureVibes, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, and settlements, including reasonable legal and accounting fees, arising from or related to:

• Your use of the Platform.
• Your violation of these Terms.
• Your violation of any rights of a third party.
• Any User Content you submit, post, or share through the Platform.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PureVibes is incorporated, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting a notice on the Platform or sending you an email.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Platform after those revisions become effective, you agree to be bound by the revised Terms.
